I build and upgrade PCs and as such I often install whatever the customer brings along.
The question is, on a new build, if someone asks for Windows 10 and they don't have a license for ANY Windows OS, by installing Windows 10 preview would they be eligible for the free upgrade path?
IE. would it eventually be activated?

The short answer is no. However, if they join the Insiders program and then install a Windows 10 Insider Preview build, they will have a legitimate copy of Windows 10 for as long as the Insider program continues. At this stage, MS says it has no plans to abolish the Insider program, however, that may well change down the track.
